Terms of Service

Welcome to WyvernIQ.
These Terms of Service (“Terms”) govern your access to and use of the WyvernIQ platform, applications, websites, APIs, support portals, reports, and related services (collectively, the “Services”). By accessing, using, purchasing, or registering for the Services, you agree to be bound by these Terms.
Use of Services
WyvernIQ provides cybersecurity, cyber risk management, threat intelligence, compliance automation, security analytics, attack surface intelligence, insider threat monitoring, executive reporting, and related services designed to help organizations understand, measure, and improve their cyber health.
You may use the Services only in accordance with these Terms and all applicable laws and regulations. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Access to the Services is limited to authorized users. You may not attempt to gain unauthorized access to any systems, data, networks, accounts, or tenant environments that do not belong to your organization.
Customer Accounts
Certain features require the creation of an account. You agree to provide accurate and complete information and to keep that information current. You are responsible for maintaining the security of your credentials and for restricting access to authorized personnel within your organization.
WyvernIQ reserves the right to suspend or terminate accounts that violate these Terms, create security risks, or engage in unauthorized activity.
Customer Data
You retain ownership of all data submitted to the Services. By using the Services, you grant WyvernIQ a limited right to process, store, analyze, and transmit such data solely for the purpose of delivering, securing, supporting, and improving the Services.
WyvernIQ does not sell customer data. Customer data is processed in accordance with applicable laws and our Privacy Policy.
Security and Platform Integrity
WyvernIQ employs commercially reasonable administrative, technical, and organizational safeguards designed to protect customer information and maintain platform integrity. While we strive to provide a secure environment, no system can guarantee absolute security.
Customers remain responsible for securing their own environments, endpoints, credentials, and internal access controls.
Any attempt to interfere with, disrupt, reverse engineer, exploit, or compromise the Services is strictly prohibited.
Artificial Intelligence Features
Certain Services may utilize artificial intelligence, machine learning, predictive analytics, automation, or large language models to generate recommendations, insights, risk assessments, summaries, or other outputs.
These outputs are intended to support decision-making and should not be relied upon as the sole basis for operational, legal, regulatory, financial, or compliance decisions. Customers are responsible for reviewing and validating all recommendations before implementation.
Compliance and Risk Information
The Services may provide compliance mappings, control assessments, cyber health scores, recommendations, risk ratings, security findings, and related reporting. Such information is intended to assist customers in understanding and managing cybersecurity risk.
WyvernIQ does not guarantee regulatory compliance, audit success, certification approval, authorization outcomes, or the effectiveness of any recommendation. Responsibility for compliance and security decisions remains solely with the customer.
Third-Party Services
The Services may integrate with or rely upon third-party technologies, cloud providers, identity platforms, security tools, productivity services, and other external systems. WyvernIQ is not responsible for outages, interruptions, data loss, service failures, or security incidents caused by third-party providers.
Intellectual Property
The Services, including all software, source code, algorithms, analytics engines, reports, dashboards, trademarks, logos, documentation, content, and intellectual property associated with WyvernIQ, remain the exclusive property of WyvernIQ and its licensors.
Nothing in these Terms transfers ownership rights to customers. Except as expressly authorized, customers may not reproduce, distribute, modify, reverse engineer, or create derivative works based on the Services.
Fees and Subscriptions
Access to certain Services may require payment of subscription fees. All fees are due according to the applicable agreement, order form, invoice, marketplace subscription, or contract.
Failure to satisfy payment obligations may result in suspension, restriction, or termination of access to the Services.
Service Availability
WyvernIQ will use commercially reasonable efforts to maintain the availability of the Services. However, Services may be unavailable from time to time due to maintenance, upgrades, infrastructure failures, third-party outages, force majeure events, or circumstances beyond our reasonable control.
WyvernIQ does not guarantee uninterrupted or error-free operation.
Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, WyvernIQ disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.
Limitation of Liability
To the fullest extent permitted by law, WyvernIQ shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of revenue, profits, data, business opportunities, goodwill, or business interruption.
In no event shall WyvernIQ’s total aggregate liability exceed the amount paid by the customer for the Services during the twelve months preceding the event giving rise to the claim.
Termination
WyvernIQ may suspend or terminate access to the Services at any time if these Terms are violated, payment obligations are not met, use of the Services creates security risks, or termination is required by law.
Upon termination, all rights granted under these Terms immediately cease.
Changes to These Terms
WyvernIQ may update these Terms from time to time. Updated versions will be posted on our website and become effective upon publication. Continued use of the Services after such updates constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising from or relating to the Services shall be subject to the exclusive jurisdiction of the courts located within the State of Florida.
